Marijuana is fully legal in Guam for both recreational and medical use. Additionally, cultivation is allowed for medical patients and adults over 21. Hemp-derived cannabis products containing cannabinoids such as CBD and delta-8 THC containing .3% THC or less are also legal in Guam under the 2018 Farm Bill.

The U.S. territory has not imposed further restrictions on products containing these cannabinoids. However, there are still penalties for violating possession, distribution, and cultivation limits.

Medical Cannabis Laws

Cannabis has been legal for medical use since 2013 through the passage of Public Law 32-237. Guam was the first U.S. territory to create a legal medical cannabis program. Although neither recreational nor medical cannabis carries a tax that consumers pay, there are still benefits to obtaining your medical cannabis card in Guam.

Medical cannabis patients can possess 2.5 ounces of cannabis, unlike recreational users who can only possess 1 ounce. People with medical cannabis cards can also grow double the amount of plants as recreational users. This expansion of possession and cultivation limits is more convenient and can save you time in the short and long term.

Recreational Marijuana Laws

Recreational cannabis was legalized in 2019 via the passage of the Guam Cannabis Industries Act. This legislation permits adults 21 or older to possess up to 1 ounce of cannabis or 8 grams of cannabis concentrate. It also allows for the private cultivation of six plants in a secure location, with no more than three plants being mature at a given time.

There are no stated possession limits or other regulations on hemp-derived cannabinoids such as CBD, delta-8, or delta-10 THC, which are all federally legal under the 2018 Farm Bill.

While cannabis is legal in Guam, there are laws regulating the possession, distribution, and cultivation of cannabis. Breaking these laws results in penalties, including jail time and fines.

Jail time can range from 60 days to a life sentence depending on the severity of the offense. Fines range anywhere from $500 to $100,000.

Guam Has Reciprocity Laws

In 2018, Guam expanded access to medical cannabis for visitors by expanding the definition of “qualified patient,” which allowed reciprocity for registered patients in other authorized jurisdictions. Additionally, these states and U.S. territories also have reciprocity laws:

States marked with ^ have adult use programs but do not accept out-of-state cards.

Can You Grow Cannabis in Guam?

Cultivation is legal in Guam for medical cannabis patients and participants in the adult-use market. Adults 21 or older can grow up to six plants with no more than three fully mature at once. Registered medical cannabis patients in Guam can grow up to twelve plants with no more than six mature plants at a time.

All cultivation must transpire in an enclosed, locked space. It’s also important to be mindful of the limits on cultivation to remain within the legal limits.
