Legal limitations for Florida cardholders
Navigating the legal landscape can be tricky. Here are the key rules every Florida medical marijuana cardholder should know.
Possession limits: Florida law lets a qualified patient possess up to a 70-day supply of medical marijuana at any one time, and no more than 4 ounces of marijuana in a form for smoking. Purchases of smokable flower are capped separately at 2.5 ounces per 35-day period unless your physician requests an exception. Amounts for other forms — oils, tinctures, capsules, topicals and edibles — follow your physician’s certification and the state’s daily-dose rules.
No public consumption: You may not consume cannabis in public places, in vehicles, or on public transportation.
Cultivation is off-limits: Growing cannabis plants at home is not permitted for medical patients under Florida law.
Where you can buy: Only licensed Medical Marijuana Treatment Centers (MMTCs) — also called dispensaries — are authorized to sell medical cannabis in Florida. As of 2026, there are more than 750 licensed dispensary locations statewide. Delivery from a licensed MMTC is also permitted.
Recreational use remains prohibited: Florida does not currently allow adult-use recreational cannabis. In November 2024, voters passed Amendment 3 with 56% support — but Florida requires a 60% supermajority for constitutional amendments, so recreational legalization did not take effect. A follow-up 2026 ballot initiative also failed to gather enough valid signatures to qualify. For now, a medical marijuana card is the only legal way to access cannabis in Florida.
Firearms: The relationship between a Florida medical card and gun rights is evolving. Under federal law, medical marijuana use still disqualifies a person from purchasing or possessing a firearm. At the state level, Florida passed HB 543 (constitutional carry) — but federal restrictions still apply when purchasing from a licensed dealer. Consult a legal professional if this applies to your situation.
No job protections: Florida law does not protect medical marijuana patients from employment drug testing or adverse employment actions related to cannabis use. Employers may maintain drug-free workplace policies.
Sealed packaging required: Medical marijuana flower and low-THC cannabis must remain in tamper-proof, sealed containers sold by a licensed MMTC when transported outside your home.
