Key takeaways

  • Recreational weed is not legal in West Virginia as of October 2026. Possession is a misdemeanor (90 days to six months and/or up to $1,000), though a first offense under 15 grams is handled by conditional discharge.
  • Medical cannabis is legal under the Medical Cannabis Act (W. Va. Code ch. 16A) for 15 serious medical conditions, including severe chronic pain and PTSD. The state fee is $50, cards last one year, telehealth certification is accepted, and dry leaf is allowed for vaporization only.
  • Hemp-derived delta-8, delta-10 and similar cannabinoids are legal for adults 21+ from permitted sellers under W. Va. Code § 19-12E-12.
  • Federal law removes hemp status from lab-made cannabinoids on November 12, 2026, then from converted delta-8 and similar cannabinoids on December 11, 2026, when finished hemp products are also capped at 0.4 mg total THC per container. The state medical program is unaffected.

Short answer: No. Recreational weed is not legal in West Virginia as of October 2026, and possession without a card is a misdemeanor. Medical cannabis is legal: West Virginia residents with one of 15 serious medical conditions, including severe chronic pain and PTSD, can get a state card. Hemp-derived THC such as delta-8 is legal for adults 21+ under state law, but federal rules tighten on November 12 and December 11, 2026.

No. The state’s Office of Medical Cannabis (OMC) puts it plainly: adult and recreational cannabis use is not legal in West Virginia. The Legislature’s 2026 session ended without an adult-use bill passing, so as of October 2026 the only legal way to buy cannabis in the state is through the medical program.

Possession is still a crime. Under W. Va. Code § 60A-4-401(c), simple possession of a controlled substance is a misdemeanor punishable by 90 days to six months in jail, a fine of up to $1,000, or both. The law does carve out a softer landing for small amounts: a first offense for possessing less than 15 grams of marijuana must be handled under § 60A-4-407, the conditional discharge statute. The court can put you on probation without entering a conviction, dismiss the case when you complete it, and expunge the record six months after probation ends.

That is not decriminalization. You are still arrested, still charged, and the discharge is only available once. Searches for “is marijuana legal in West Virginia” and “is weed legal in WV” get the same answer: not unless you are a registered patient.

Yes. The Medical Cannabis Act (W. Va. Code chapter 16A) was signed on April 19, 2017, and the program is run by the OMC inside the Bureau for Public Health. If you are a West Virginia resident with a qualifying condition, you can get certified and apply for a West Virginia medical marijuana card.

West Virginia names 15 serious medical conditions in § 16A-2-1: cancer, HIV/AIDS, ALS, Parkinson’s disease, multiple sclerosis, damage to the nervous tissue of the spinal cord with intractable spasticity, epilepsy, neuropathies, Huntington’s disease, Crohn’s disease, PTSD, intractable seizures, sickle cell anemia, severe chronic or intractable pain (of neuropathic origin or otherwise), and terminal illness with a life expectancy of about a year or less.

Two things people get wrong. Glaucoma is not on West Virginia’s list, even though most states include it. And there is no practitioner catch-all: if your condition is not named, you cannot get a standard card for it, although the OMC publishes a form to request that a condition be added.

Key program facts, as of October 2026, from the OMC:

  • Telehealth is accepted. The OMC’s own renewal instructions say to schedule your annual appointment with a registered physician “in-person or online,” and it lists telehealth companies with West Virginia-registered physicians.
  • The state fee is $50, and the bureau may waive or reduce it for financial hardship (§ 16A-5-1).
  • Cards expire one year from issue.
  • Dry leaf is allowed, smoking is not. Approved forms are pill, oil, topicals, tincture, liquid, dermal patch and a form for vaporization or nebulization, which includes dry leaf or plant form. Burning it, with papers, pipes or anything else, is unlawful (§ 16A-3-3). Dispensaries do not sell edibles.
  • Purchase limit: up to 6 ounces of flower or 60 grams of concentrate (or an equivalent mix) per rolling 30-day period, unless your physician sets a lower amount.
  • Patients under 18 need a caregiver, normally a parent or legal guardian.

What about hemp THC, delta-8 and THCA in West Virginia?

If your question is “is THC legal in West Virginia,” the answer depends on where the THC came from. Marijuana THC is medical-only. Hemp-derived cannabinoids are a separate, regulated category. W. Va. Code § 19-12E-12, enacted in 2023 and amended in 2024, treats delta-8, delta-10, HHC, THCP and THCV as hemp-derived cannabinoids that can be sold to adults 21 and older by sellers holding a permit from the Department of Agriculture, with product registration, lab testing and warning labels. Selling to a minor is a felony.

Federal law is about to narrow that shelf. Congress rewrote the definition of hemp in November 2025, with two deadlines:

  • November 12, 2026: cannabinoids the cannabis plant cannot make on its own (THC-O and similar lab-made compounds) lose federal hemp status.
  • December 11, 2026: natural cannabinoids synthesized or converted outside the plant (most delta-8, delta-10 and HHC) are excluded too, hemp is measured by total THC (including THCA), and any finished consumer product with more than 0.4 mg of total THC per container is no longer hemp. That covers THCA flower and most hemp delta-9 gummies.

West Virginia’s medical program is a state program and is not affected. The delta-8 products that are legal in West Virginia today will be federally outside the hemp definition after those dates, and the state has not yet said how it will respond. Our guide to the federal hemp THC ban follows the details.

Medical is the only legal route in West Virginia

Severe chronic pain, PTSD and 13 other conditions qualify. A licensed physician evaluates you online.

How to get a medical card in West Virginia

  1. Get certified by a physician registered with the OMC. A licensed physician evaluates you, online or in person, and confirms whether you have one of the 15 conditions. With Leafwell, the appointment is the evaluation. Nobody can promise the outcome.
  2. Apply through the OMC portal with your certification, a West Virginia driver’s license or ID, a digital photo and the $50 fee (or a hardship waiver request). The OMC reviews applications within 30 days and emails you the status.
  3. Download your digital card from the portal once approved.
  4. Buy at a licensed dispensary with your card and photo ID, within your 30-day allotment.

What the card costs overall, including the evaluation, is in our medical marijuana card cost guide.

WV medical marijuana card renewal

Your card expires one year from issue. To renew, book your annual physician appointment (in person or online), then submit a renewal application in the portal. The OMC accepts renewals up to 60 days before expiry, and a renewal approved early still gets an expiration date one year from your original one, so you lose nothing by renewing ahead. The $50 fee applies again. Our guide on how to renew a medical marijuana card covers timing.

West Virginia cannabis laws: what changed in 2026

  • April 28, 2026: state-licensed medical marijuana moved to Schedule III under federal law (91 FR 22714). Recreational cannabis stays in Schedule I. This does not make cannabis federally legal. See what rescheduling means for patients.
  • March 4, 2026: the House of Delegates passed HB 5260, which would have let dispensaries sell edible forms to patients. It was referred to the Senate Health and Human Resources Committee on March 5 and died there when the session ended. Edibles are still not available.
  • Coming November 12 and December 11, 2026: the federal hemp deadlines above.

The medical program itself did not change in 2026: same 15 conditions, same $50 fee, same one-year card, telehealth still accepted.

Frequently asked questions

Is weed legal in WV?

Not for recreational use. As of October 2026, West Virginia has no adult-use cannabis law and possession without a medical cannabis card is a misdemeanor. Medical cannabis is legal for West Virginia residents certified for one of 15 serious medical conditions.

Is marijuana legal in West Virginia for medical use?

Yes. The Medical Cannabis Act, signed April 19, 2017, lets residents with a serious medical condition such as severe chronic pain, PTSD, cancer, epilepsy or Parkinson’s disease get certified by a registered physician and apply to the Office of Medical Cannabis for a card. The state fee is $50 and the card lasts one year.

Is THC legal in West Virginia?

It depends on the source. THC from marijuana is legal only for registered medical cannabis patients. THC from hemp, including delta-8, delta-10 and hemp-derived delta-9, is legal for adults 21 and older when sold by a seller permitted by the Department of Agriculture. Federal rules narrow the hemp category on November 12 and December 11, 2026.

Is delta-8 legal in West Virginia?

Yes under state law, as of October 2026. W. Va. Code § 19-12E-12 treats delta-8 as a hemp-derived cannabinoid that may be sold to adults 21+ by permitted sellers with registered, tested and labeled products. Under federal law, converted cannabinoids such as delta-8 lose hemp status on December 11, 2026 (lab-made cannabinoids go first, on November 12, 2026).

What happens if you get caught with weed in West Virginia?

Simple possession is a misdemeanor punishable by 90 days to six months in jail, a fine of up to $1,000, or both. A first offense for less than 15 grams must be handled under the conditional discharge law: probation without a conviction, dismissal on completion, and the chance to expunge the record six months later.

Can you smoke flower with a West Virginia medical card?

No. Dry leaf or plant form is an approved form, but only for vaporization. Burning medical cannabis with rolling papers, a pipe, a water pipe or any other combustion method is unlawful under the Medical Cannabis Act. Edibles are not sold by dispensaries either.

How do I renew my WV medical marijuana card?

Book your annual appointment with a registered physician, in person or online, then submit a renewal application in the Office of Medical Cannabis portal and pay the $50 fee. You can renew up to 60 days before your card expires, and an early renewal still gets an expiration date one year after your original one.
