MEMBER ACKNOWLEDGMENT & CONSENT
Leafwell Cannabis Care Benefit
Please read the following before participating in the Cannabis Care Benefit provided by Leafwell, Inc. (“Leafwell”). Participation is voluntary.
- What this program is. This is a voluntary benefit that gives you access to a telehealth consultation with a licensed healthcare provider and, if the provider determines it is appropriate and you qualify, a low-THC medical cannabis prescription under the Texas Compassionate Use Program (CUP). The provider exercises independent medical judgment; Leafwell provides administrative support and does not practice medicine or direct your care.
- Cost; product is self-pay. Your health plan covers the consultation as described in your benefit materials (a $20 copay applies). Any cannabis product is purchased by you, at your own expense, from a licensed Texas dispensing organization (a discount may be available). Your employer and your health plan do not pay for or reimburse cannabis product – including through any FSA, HSA, HRA, or similar account.
- No employment protection (important). Texas law does not protect you from your employer’s drug-testing or drug-free-workplace policies, or from discipline or termination, because you participate in this program or use medical cannabis. This program does not change your employer’s policies (including Board Policies DH and DHE) and gives you no protection from a positive drug test or its consequences.
- Safety-sensitive and regulated roles. If you drive a commercial vehicle or bus, hold a commercial driver’s license, perform a DOT/FMCSA safety-sensitive job, are a commissioned peace officer, carry a firearm as part of your job, or are subject to a federal contract or zero-tolerance rule, using cannabis — even lawful low-THC — may disqualify you from your position and may violate federal law. You may be excluded from the prescription part of the program. You agree to tell Leafwell and your provider if any of these apply to you.
- Drug testing. A low-THC product may cause a positive drug-test result. If you are tested, you may tell the tester or medical review officer about your CUP prescription, but a positive test may still lead to consequences under your employer’s policy and under federal rules.
- Your privacy. Your health information is kept confidential and handled under HIPAA and Leafwell’s privacy notice. Your employer will not be told whether you participate or what care you receive; your employer receives only aggregated, de-identified information. You consent to Leafwell and its providers using and sharing your information as described in the privacy notice and applicable agreements to provide the program.
- Communications. You agree that Leafwell may contact you about the program and how to enroll by email and by text/SMS message (message and data rates may apply). You can opt out at any time — reply STOP to text messages, or use the unsubscribe option in an email.
- Voluntary; not advice from your employer. Participation is your choice, and you may stop at any time. This program is not medical or legal advice from your employer, and your employer does not direct or receive your individual care.
