Benefits of Having a Medical Card in West Virginia

Applying for a West Virginia medical marijuana card is the only way residents can legally purchase and consume cannabis in the state. Recreational sales and home cultivation of cannabis remain illegal under state law.

Purchase and Possession Limits

Medical cannabis patients in West Virginia can purchase up to a 30-day supply of medical cannabis products from licensed dispensaries. A 30-day supply is defined as 6 ounces of flower or 60 grams of concentrate, or an equivalent combination of the two.


Eligibility Requirements

West Virginia residents aged 18 and up diagnosed with at least one qualifying medical condition may be eligible to apply for a medical cannabis card. First, they must register for a consultation with a state-licensed healthcare provider and get approved. With Leafwell, patients can complete this consultation online via telemedicine.

Can Minors Get a Medical Card in West Virginia?

Yes. But for an individual under 18 to obtain a West Virginia medical card, they will need a caregiver to apply on their behalf. Caregivers for minor patients must be one of the following:

  • A parent or legal guardian of the patient
  • An individual designated by a parent or legal guardian
  • An individual approved by the bureau if no parent or legal guardian is appropriate or available

Caregivers

West Virginia defines a caregiver as someone at least 21 years or older who has been approved to obtain medical cannabis from state dispensaries and deliver it to a patient. Patients may not designate more than two caregivers; a caregiver may not serve more than five patients at once.

Caregivers must apply online for a separate identification card and undergo a criminal background check. Caregivers must not have been convicted of a drug felony within the past five years. There is a $50 nonrefundable application fee.



What You’ll Need to Apply

To register for your West Virginia MMJ card, you will need to provide medical records, identification documentation, and payment for state fees. You should gather the following:

  • A signed medical certification issued by a practitioner and submitted to the state (this can be obtained with Leafwell)
  • I.D.
    • Valid, unexpired driver’s license
    • State-issued ID card
    • Passport
  • Proof of residency
    • Utility bills
    • Correspondence with a state department
    • Bank statements
    • Mortgage or rental agreements
  • $50 for state processing fees
  • A digital photograph (which will be used on the card)

Costs

Online consultation with one of Leafwell’s healthcare providers costs $149. However, you will not be charged if you do not qualify for your MMJ card.

The state also charges a $50 nonrefundable fee each time you apply. This fee may be waived if your household income is twice that of the federal poverty level.


Medical Marijuana Reciprocity

West Virginia does not currently accept out-of-state medical marijuana cards. The state could create reciprocity agreements with similarly regulated states to allow terminally ill cancer patients to purchase medical cannabis. No such agreements have been made as of December 2022.

How does the online evaluation process work for getting a Medical Marijuana certificate Letter/Medical Certificate in West Virginia?

There are three simple steps to seeing a Leafwell healthcare provider to get approved for a West Virginia medical marijuana card:

  1. Register with Leafwell and speak to a West Virginia-licensed healthcare provider via our HIPAA-compliant telehealth platform, which involves creating a Leafwell account using a valid email address. You’ll be asked to complete a brief questionnaire of personal and health information and to either take or upload a photograph of identification (we’re required by law to verify your identity). You will need a smartphone, computer, or tablet with a reliable internet connection and a working camera to be seen by a Leafwell provider.
  2. Schedule an appointment or enter the virtual waiting room. You will receive a text message on your cell phone when the provider is ready to see you, and then you’ll be connected to a Leafwell healthcare provider for a video chat (i.e., a virtual doctor’s visit). During the visit, your provider will assess your medical condition(s) to determine if you qualify for a West Virginia medical marijuana certification.
  3. Once approved, your provider will submit your certification to the state. You’ll then complete and submit your state application to the West Virginia Medical Cannabis Program online. Applications are processed within 30-60 days and you’ll receive an email with your application status. If your application is approved, your digital card will be available to download from your state account immediately.

Can I be/have a caregiver for a medical marijuana patient in West Virginia?

Yes, medical marijuana patients in West Virginia can have a caregiver. Caregivers must submit an application after the patient is approved.

Caregiver Requirements:

  • Minimum 21 years old
    • Certain circumstances may allow for someone under 21 years old to be a caregiver. The patient and caregiver will need to contact the program.
  • A background check is required.
  • Caregivers may serve up to five (5) patients. Patients may have up to two (2) caregivers.
  • $50 nonrefundable fee. The bureau may waive or reduce the fee in cases of demonstrated financial hardship.

Here’s how to apply as a caregiver:

  1. Complete the Patient Authorization for Designation of Caregiver form. The form must be notarized.
  2. Complete the Criminal Background Check Rights Acknowledgement form.
  3. The caregiver or parent/guardian will apply after the patient has received his/her approval from OMC.
  4. You will need to create an account with the West Virginia Medical Cannabis Portal by entering your email address and creating a password for the account. If you have an existing account, sign in and skip to step 7.
  5. Enter your registration information.
  6. Once you have entered the registration information and submitted, you will receive an email from Complia with a link to verify your account. When you click on the link, you will be automatically directed back to the website.
    1. To request another verification email, please visit https://wvpublic.mycomplia.com/#!/resendVerifyAccountEmail.
  7. Once your account is verified, sign in to your account to start the application.
  8. Click on +Create New Application.
  9. Click on New Caregiver Registration and then click Create Application.
  10. Provide the requested information.
  11. Caregivers are required to submit a $50.00 processing fee for the application unless requesting a waiver based on financial hardship.
  12. You will need to upload a copy of the Patient Authorization for Designation of Caregiver and the Criminal Background Check Rights Acknowledgement forms as part of the application
  13. You will also be required to submit fingerprints for a criminal background check through IdentoGo.

How do I apply for the state program in West Virginia?

Before you start, have these documents to hand:

  • Digital photo of passport quality
  • WV driver’s license, WV state ID, Passport or Birth Certificate with proof of residency
  • Proof of West Virginia residency. Click here to view acceptable documentation
  • If requesting a waiver of the fee based on financial hardship (income below 200% of the federal poverty level), provide acceptable proof of income, such as W-2, recent pay stubs, proof of benefit eligibility, etc. Please do not send a payment if you are requesting a fee waiver. If the waiver is not granted, you will be notified to submit the fee at that time.

Here’s what you need to do after you’ve been approved by a Leafwell physician:

  1. Create a new Patient Registration: https://wv-public.mycomplia.com/#!/signin
    1. In the upper right corner of the screen, click on Register to create an account.
    2. Once you have entered the registration information and submitted, you will receive an email from Complia with a link to verify your account.
  2. Once your account has been verified, log into Complia and create an Application for a New Patient Registration.
  3. Complete the application.
    1. When you come to the Physician/Condition Information tab, it is required to choose “Online – Electronic Certification.”
    2. You will then need to click on the “View Available Certifications” green button.
  4. Upon completion of the application, including uploading all documents, click Submit. A confirmation screen will appear with the Application ID number.
  5. Mail payment (check or money order payable to WV DHHR) to: WV Office of Medical Cannabis, 350 Capitol Street, Room 523, Charleston, WV 25301. The Application ID number and patient name must be in the memo line of the check or money order.
  6. You will be notified via email of the status of your application within 30-60 days.
    1. Please allow at least 30 days from receipt of your application and payment in our office before checking the status of your application.
    2. If your application is denied, you will be informed of the reason. If your application needs a correction, it will be rejected and sent back to you to correct and resubmit. You will not need to create and submit a new application. If your application is approved, your WV Medical Cannabis patient card will be issued.

Registration does not mean that medical cannabis products can immediately be obtained. The industry is working to build out facilities in West Virginia and the patient card is valid only in West Virginia and offers no legal protection for products obtained outside of the West Virginia medical cannabis system.
