New Mexico residents at least 18 years old may be eligible for medical cannabis cards if diagnosed with a qualifying health condition. That will be determined by a certified physician, who must fill out an application form indicating their patient’s health issue(s) and proof of diagnosis.
Caregiver
Caregivers in New Mexico must be at least 18 years old and designated by their medical marijuana patients. A primary caregiver can serve up to four medical marijuana patients at once.

- In 2007, former New Mexico Governor Bill Richardson signed the Lynn and Erin Compassionate Use Act into law. Essentially, the Lynn and Erin Compassionate Use Act legalized the cultivation, processing, sale, purchase, and consumption of medical cannabis products in New Mexico.
- Senate Bill 523 also legalized the purchase of up to 15 ounces of marijuana over 90 days and allows patients to cultivate up to six mature plants (with a maximum of 12 plants per home).
- Recreational cannabis was legalized in New Mexico after House Bill 2, also known as the Cannabis Regulation Act, was signed into law by Gov. Michelle Grisham.
- Although recreational cannabis is legal, there are perks for patients with a medical identification card, including higher possession limits and lower sales tax on the purchase of cannabis products.
Caregivers
New Mexico defines a caregiver as a resident of the state who is at least 18 years old and who has been designated by the patient’s practitioner as being necessary to take responsibility for managing the well-being of a qualified patient with their medical use of cannabis.
Minor patients must have a primary caregiver.
Caregiver Requirements:
- At least 18 years old and a New Mexico resident.
- Patients can have one caregiver. Caregivers can serve up to four qualified patients.
- Caregivers will attend the certification appointment with the patient.
- A background check is not required for caregivers.
Caregiver Registration Process:
Once you have created a user account in the New Mexico Online Patient Portal, you can complete the caregiver application initiated by the patient’s healthcare provider.
- For a new or re-certifying patient, the caregiver will be added to the patient’s application so the medical provider and patient can approve.
- For an existing patient to add you as a caregiver, you must visit the patient’s medical provider to start a caregiver application. Once the patient approves you as their caregiver, you will receive an email notification to complete the application.
After submitting your application, it will be sent to the New Mexico Medical Cannabis Program for review, approval, and issuance of your electronic card. Applications submitted through the Online Patient Portal are typically processed within five business days.

- Click the Create an Account button. If you already have an account, skip to step 7.

- I have a card and want access to the Sales and Unit History – check this box if you currently have or have had a New Mexico Cannabis Program Patient Card.
- Barcode (as it appears on your card) – if your card is not available, you can skip this step; however, please allow 24-48 business hours for Program Staff to manually link your account.
- Email – use the personal email address you gave to your Medical Provider and plan to use it for all future applications.
- Password – create a unique password that you will use to access the Patient Portal. h. Password confirmation – reenter the password.
- Click the Submit button.
- Check your email Inbox for an account confirmation notification and confirm your email by clicking on the link in the notification.NOTE: To avoid issues receiving email messages from the Online Patient Portal, please add the email address no-reply@biotrackthc.org to your Safe Senders list
- Once you have created a user account in the Online Patient Portal, you can complete the caregiver application initiated by the patient's Medical Provider.
- Log in to your account with the New Mexico Medical Cannabis Program.
- Your application will be found in the My Application section after login.
- Click on the Caregiver Application (Patient Information: Patient Name) to open the application.
- Review the Patient Information.
- Verify the information entered by the patient's Medical Provider.
- Enter your Mailing Address if not entered by the patient's Medical Provider
- Upload a New Mexico driver's license or New Mexico state-issued ID.
- Review the attestation, and then add the date and your signature.
- Once all the required information has been entered into the application, click the Review button to verify all the entered information is correct.NOTE: If the Review button is not present, review the application and enter any missing information.
- Click the Submit button. Your application will be sent to the Medical Cannabis Program for review /approval and issuance of your electronic card, typically processed within 5 business days.
How do I apply for the state program in New Mexico?
- A clear (face visible) copy of your current New Mexico driver's license or New Mexico photo ID. Temporary New Mexico driver's licenses and photo IDs are acceptable.
- Create an Account with the New Mexico Department of Health Cannabis Program online.
- Upon completion, you will be directed to check your email account for an email from the state.
- To verify your email and confirm registration, simply click on the blue link found in the email. This action will take you back to the NMDOH patient portal home page.
- Log in to the patient portal.
- Complete and submit an official state application.
